If one is driving on a road and a pedestrian is suddenly encoutered in the car's lane, the pedatstrian is not considered to be a pursuer if the driver can stop or swerve without causing a fatal accident.
But if someone on foot just walks onto the highway and swerve or brake would cause a fatal accident on the highway, it is permissible for the driver to continue forward and fatally strike the person who is suddenly in his lane.
